Q&A about Foreigner’s Work Permit

In accordance with the decision of the State Council’s Administrative Examination and Approval Reform Office, the Employment Permit for Foreigners and the Foreign Expert Work Permit are integrated into the Foreigner's Work Permit in China. The new work permit system for foreigners in China is fully launched around the country on April 1, 2017.

1. What are the basic requirements for application?
1). The applicant should be 18 years old or above, be in good health, have no record of criminal conviction, be employed by a legally-established unit, and be professionally or academically competent for the job.
2). The applicant should be a professional in urgent need by China and his job should meet the demands of China’s economic and social development.
3). Other requirements concerning foreigners working in China as stipulated in laws and regulations must be followed.

2. What are the basic procedures for application of Foreigner’s Work Permit?
Foreigners applying for a work permit in China from within or outside China, or for extension or cancellation of their existing work permits should go through the following procedures:

Online preliminary review.
Acceptance.
Review.
Decision.

3. How long does it usually take to get a Foreigner’s Work Permit?
Decision-making bodies should review applications for a Foreigner’s Work Permit, make a decision within 20 working days and inform the employer. An extension of another 10 working days may be considered under special circumstances. The time needed between the applicant’s reception of the Notification Letter of Foreigner's Work Permit and the issuance of the Foreigner’s Work Permit Card for the purpose verification of relevant application materials shall be excluded from the time limit.

4. What are the processing agencies of Foreigner’s Work Permit?
Processing agencies are the administrative departments for processing applications by foreigners for work permits in China under the provincial people’s governments and the Xinjiang Production and Construction Corps, as well as the administrative departments for foreigners working in China under local people’s governments authorized by them or relevant agencies entrusted by them for this purpose.

5. What are the decision-making bodies?
Decision-making bodies are the administrative departments for adjudicating upon applications by foreigners for work permits in China under the provincial people’s governments and the Xinjiang Production and Construction Corps, as well as their legally authorized administrative departments for foreigners working in China under the local people’s governments.

6. What is the quota for foreigner’s Work Permit?
No quota is set for the introduction of high-end foreign talents (Category A); the number of foreign professional talents (Category B) shall be limited based on market demand; and any restriction on ordinary foreigners (Category C) is subject to China’s relevant regulations. Inquires may be made through the Management and Service System for Foreigners Working in China.

7. What are the supervision and complaint channels?
1). Complaints can be made through counter services, telephone calls, emails and letters, which are subject to separate announcements made by local processing agencies and decision-making bodies handling applications for the Foreigner’s Work Permit.
2). Online complaints: Complaints can be filed online via the Management and Service System for Foreigners Working in China.
